Chilling Effect on Short Sales Unless New Bill Passes

The Mortgage Forgiveness Debt Relief Act of 2007 ("2007 Act") provides for an exemption for any income tax on debt forgiveness for money used to purchase, or make improvements to, a principal residence. This 2007 Act is scheduled to expire January 1, 2013. If there is no extension of this 2007 Act, a seller will pay income tax on the amount of the debt forgiveness by a lender in a short sale. For example, if a homeowner with a $250,000 mortgage does a short sale for $150,000, the homeowner will have to pay income tax on the amount of the $100,000 debt forgiveness.

On March 19, 2012, Representative Charles Rangel (D-NY), the sponsor of the 2007 Act, introduced a new bill HR 4202, Mortgage Cancelation Relief Act of 2012 ("proposed 2012 Act"). This proposed 2012 Act is basically one sentence extending the January 1, 2013, expiration date of the 2007 Act for two years until January 1, 2015.

Seems simple, but politics are involved. The current Speaker of the House, John Boehner, voted against the passage of the 2007 Act. Furthermore, although all of the other Democrats besides Rep. Rangel on the House Ways and Means Committee are co-sponsors of the proposed 2012 Act, none of the 22 Republicans on the House Ways and Means Committee agreed to be a co-sponsor. Therefore, the chances of passing the two-year extension are problematic. In fact, the website www.govtrack.us, which tracks the passage of Congressional legislation, states that "we think this bill has a 9% chance of passing Congress."

If there is no passage of the proposed 2012 Act, or any other extension of the current debt forgiveness law, there will be a chilling effect on the recovering housing market. The number of short sales will be significantly reduced. Many "underwater" homeowners will continue to make their mortgage payments and hope that the value of their home eventually appreciates to the amount of their mortgage, rather than do a short sale and pay a significant tax bill.

Finding Soul Where We Live in Carefree Arizona

If we are fortunate, we chose where we live. In fact, where we live can change us. Eleven years ago, Kathie and I moved 20 miles north from Scottsdale, Arizona to Carefree, Arizona. Carefree and neighboring Cave Creek are in the high Sonoran desert, a place of incredible natural beauty.

We had eaten in Carefree’s restaurants and Cave Creek’s cowboy salons, visited art galleries, attended wine festivals, and checked out the merchandise in the funky shops. The majestic mountains, saguaro studded hillsides and golden red sunsets energized us and we wanted to feel inspired and renewed every day.

Shortly after we moved, Kathie shocked me by telling me she liked living here so much that she was going to make a career change. At the time, she was a senior healthcare executive. She said, “It’s time for a change. I’m going to become a Realtor and help people find their perfect house in this beautiful community.” I was a little anxious about this major career change, but I shouldn’t have been concerned.

Eleven years later, Kathie has not lost her passion for helping people find a new home. Her customers, who come from all over the country and from the Valley of the Sun, have previously visited the area. Like us, they want to live here, not just visit.

I like that others want to live where we live – just not too many of them, but enough to keep Kathie busy. This is a special place of soul connection to Mother Nature to be enjoyed, shared and kept pristine. Phoenix Arizona Housing Market is Recovering

According to Realtor.com, the official site of the National Association of Realtors, some of the cities whose housing markets bore the brunt of the foreclosures are now leading the way toward recovery.

Using data from Realtor.com, CNBC.com ranks the cities with the most dramatically recovered housing sectors. The list weighs year-over-year data from the fourth quarter of 2011 and the fourth quarter of 2010, such as median price appreciation, median age of inventory, inventory reduction rates and unemployment rates, as measured by the Bureau of Labor Statistics in November 2011.

Phoenix-Mesa, AZ made this year's list of top 5 turnaround towns:

Year-over-year Median List Price Appreciation: 15.38%

Year-over-year Median Age of Inventory: -27.47%

Year-over-year Inventory: -48.10%

Unemployment Rate (November): 7.7%

Search/Listing Ratio Rank: 7

The Phoenix-Mesa area experienced more than its fair share of foreclosures, and one in every 317 homes still goes into foreclosure. However, the foreclosed homes on the market are being sold at bargain prices, which has caused a 27.47 percent decrease in the median age of inventory.

The city’s unemployment rate in November was 7.7 percent, better than the national average, which can only help boost the local economy.

The Call of the Coyote

It ‘s late afternoon in December, yet warm enough for me to be sitting outside, quietly looking at majestic Black Mountain, the center-point of our Carefree/Cave Creek community. From some place beyond the swimming pool is pristine desert, untouched by human activity, and I hear the distinctive call of a coyote, but I can’t see him.

When I hear a coyote, I have both an eerie and an awesome feeling about these savvy animals. I wonder whether he is singing, crying, talking to a friend, or like Wiley E. Coyote trying to entice another creature to be his meal. There is also the possibility he is speaking to me.

I wonder what it’s like to be a coyote, living in what is left of their desert between our houses and neighborhoods. Our presence is new for them. For thousands of years, before houses were planted here, the coyotes, their prey, and their predators had free run of the place between mesquites, saguaros, and desert brush. I understand coyotes usually den year after year in the same location so they seem to have adapted quite well.

I listen for what the coyote might be saying. I think he’s asking me to pause and think about what is most important. He reminds me of the importance of connection: connection to all creatures “great and small” and our connection with the infinite universe beyond Black Mountain. Mr. Coyote has been a wonderful happy hour companion, even without seeing him.

Head North to Cave Creek AZ!

Hello all! This is my first time blogging and I have to admit that I embraced the opportunity as I am excited to be writing about one of my favorite subjects-Cave Creek Arizona!

I’ve been fortunate to live in the area for about 12 years and I love to brag about it to anyone I meet that hasn’t yet discovered this area, weather from they are from out of state or other parts of the Valley.

Cave Creek is home to many unexpected surprises and it always amazes me how few people that live in the Phoenix Metro area haven’t ventured up this way. It’s only a short 15-20 minute car-ride, or a mellow cruise up on your bike, from the Loop 101 and Scottsdale Road, but feels like a different world once you arrive. It’s a world away from the bustling downtown and to some, feels like a journey back in time to the old Wild West days when life moved at a slower pace. I like to describe the town as a mix of artsy, cowboy and funky with just enough sophistication thrown in to appeal to most everyone-wonderfully eclectic!

In addition to being at a bit higher elevation than other parts of the Valley, it’s a bit cooler up here and we’re fortunate to have a gorgeous range of mountains all around us so the views from most parts of town are gorgeous. It’s normally very peaceful and a bit of a sleepy little town but the population grows in the winter months and weekends as folks head up here to get out of the cold or to take in some of the weekend goings-on.

We have some of the best coffee joints, wine bars, restaurants and bars in the Valley and are overflowing with shops and galleries to keep you busy for a day (weekend or longer) discovering all that the town has to offer.

The residents here are warm and welcoming and love to see new faces, and there are always a few local characters hanging around sipping a cup of locally roasted coffee or a cold beer that are happy to bend your ear with an interesting story or two. Should I Buy a Home Now?

I'm often asked if this is a good time to buy a home. Some clients are concerned that home prices may fall further than they have already. They are assuming that the best course of action is to wait for the bottom in the market and then buy. The problem with this approach is that you don't know where the bottom is until you see it in the rear view mirror, meaning until you've missed it!

Home prices are one factor in determining your cost of ownership, but so are interest rates and financing availability. Even though interest rates have gone up in the last six months, they are still near historic lows. Since your monthly mortgage payment is a combination of paying down your principal and paying the interest owed, if home prices come down a little further but interest rates up, it could cost you even more to service a mortgage on an identical home!

While a home is a major investment, it is also the center of your personal life. It's important to live in a home that reflects your taste and values, yet is within your financial "comfort zone." To that end, it may be more important to lock in today's relatively low interest rates and low home prices, rather than to hope for a further break in prices in the future.
